The preliminary hearing for Tyler Robinson, who stands accused in the death of Charlie Kirk, is nearing its conclusion in Provo, Utah. A key piece of evidence, video testimony from Lance Twiggs, Robinson's former romantic partner, is scheduled for presentation in court Thursday morning.
Prosecutors had initially intended to show the video on Wednesday. However, after objections raised by the defense, Judge Tony Graf Jr. issued an order for specific portions to be redacted. Prosecutors then opted to delay the playing of the testimony until Thursday morning to ensure full compliance with the court's directive.
The Debate Over Redactions
The decision to redact the video testimony sparked a fervent discussion in the courtroom. Erika Kirk, Charlie Kirk's widow, was observed sharing emotional embraces with her mother-in-law, Kathy Kirk, and wiping away tears. The family's attorney, Jeff Neiman, addressed the court, advocating for the entirety of the unredacted video to be shown "for all the world to see." From the public gallery, Ms. Kirk appeared to encourage the attorney to approach the podium, marking her first visible engagement since the hearing commenced on Monday.
Neiman contended that playing only a redacted version of the testimony could foster "doubt and distrust in the judicial system." He conveyed the Kirk family's strong conviction to Judge Graf, stating, "The Kirk family believes strongly that if the evidence is being admitted in this preliminary hearing, it should be made public for the world to see no redactions." He further asserted that the court possessed the necessary mechanisms to guarantee a fair trial for the defendant and would employ them if deemed necessary.
Despite these arguments, Judge Graf agreed to implement the redactions, which will remove approximately 16 minutes from the roughly 37-minute video statement provided by Twiggs. This decision aligned with suggestions from the defense, after Robinson's attorney, Richard Novak, expressed constitutional concerns regarding the public broadcast of what could be perceived as a "confession" prior to a full trial.
Key Evidence and Allegations
The complete video is anticipated to feature Twiggs discussing various communications, including text messages, chat logs, and a written note. The defense has indicated that prosecutors and the public might interpret these items as a "confession" from Robinson, though Novak clarified that the defense does not characterize them as such.
Throughout the hearing, Robinson displayed signs of discomfort, particularly during references to Twiggs, who was his partner at the time of the shooting. He was observed taking deep breaths, fidgeting, and adjusting his suit jacket.
Some of the alleged text message exchanges between Robinson and Twiggs have already been publicly disclosed. In these communications, prosecutors contend that Robinson mentioned being "stuck in Orem," the location where the shooting occurred, and seemingly accepted responsibility, stating he was "the one who did it." While these specific textual mentions are expected to be redacted from the video presented on Thursday, Judge Graf confirmed he would still consider them when making his probable cause determination.
Hearing Conclusion Anticipated
Judge Graf also announced that the preliminary hearing is set to conclude by 5 p.m. on Friday, dispelling earlier speculation that the five-day proceeding might extend beyond its planned duration.
As the court session concluded and attendees rose, Erika and Kathy Kirk were seen sharing a tearful embrace.
